Legal Responsibilities
Under Section 19 of the Education Act 1996, local authorities have a legal duty to ensure that children of compulsory school age—who are unable to attend school due to illness, exclusion, or other reasons—receive access to suitable alternative education. This applies to children both with and without an Education, Health and Care Plan (EHCP).
